2. Who May Use Our Services
Our apps are designed for children, but these Terms form an agreement with the adult responsible for the child.
A parent or legal guardian must download, purchase, configure, or authorize a child’s use of our apps. Children should use the apps only with the permission and appropriate supervision of a parent, guardian, teacher, or other responsible adult.
If you use our services on behalf of a school, preschool, company, NGO, or other organization, you confirm that you have authority to accept these Terms on its behalf.
You must be legally capable of entering into an agreement under the laws that apply to you.
3. Our Apps and Services
These Terms apply to:
- Trigonom mobile and tablet applications;
- the Trigonom website and individual app pages;
- educational games, activities, images, sounds, animations, and other content;
- optional child profiles and progress features;
- customer support and privacy requests;
- school, preschool, and institutional licensing inquiries; and
- related services offered by Trigonom.
Some features may vary by app, device, operating system, country, language, or app store.
4. License to Use Our Apps
Subject to these Terms and any applicable app-store rules, Trigonom grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use our apps on compatible devices that you own or control.
Unless you have a separate written institutional agreement with Trigonom, this license is intended for personal, family, and noncommercial educational use.
You may not:
- copy, sell, rent, sublicense, distribute, or commercially exploit an app or its content;
- reverse-engineer, decompile, disassemble, or attempt to obtain an app’s source code, except where applicable law expressly allows it;
- remove or alter copyright, trademark, attribution, or ownership notices;
- modify an app or create derivative works based on it;
- bypass payment, subscription, licensing, security, or access-control mechanisms;
- use automated systems to scrape, overload, test, or interfere with our services;
- use our apps or content in a way that violates the law or the rights of another person; or
- falsely represent that you are affiliated with or endorsed by Trigonom.
No ownership rights are transferred to you.
5. Child Profiles and Learning Progress
Certain apps, including Montessori Learning Activities and Preschool Learning Games, may allow a parent or guardian to create an optional child profile.
Depending on the app and features selected, the profile may include:
- a child’s first name;
- the child’s age;
- an optional parent email address;
- a randomly generated profile identifier;
- completed learning activities or games; and
- activity timestamps and learning progress.
Providing a child’s name, age, or parent email is optional unless a particular feature clearly states otherwise. A parent or guardian should provide only the information necessary to use the selected feature.
Trigonom does not require children to create accounts or sign in independently.
Information about how we process app and website data is provided in our Privacy Policy:
https://trigonom.al/privacy-policy/
6. Privacy Requests and Data Deletion
A parent or guardian may request access to, correction of, or deletion of app data through our dedicated request page:
https://trigonom.al/app-data-request/
To help us locate the correct record, we may request:
- the parent email used in the app;
- the app name;
- the child profile name;
- the random profile ID, if available; and
- the type of request being made.
We may need to verify that the person submitting the request is authorized to act for the child. We will process valid requests in accordance with applicable law and our Privacy Policy.
Deleting app data or uninstalling an app does not automatically cancel an app-store subscription.
7. Purchases, Subscriptions, and Paid Features
Apps may include paid downloads, in-app purchases, subscriptions, ad-removal options, or other paid features.
Payments are processed by the platform through which the purchase is made, such as:
- Apple App Store;
- Google Play;
- Huawei AppGallery; or
- Amazon Appstore.
Trigonom generally does not receive or store your complete payment-card information.
Prices, currencies, taxes, trial periods, subscription terms, and available features may vary by platform and location. The information displayed by the applicable store at the time of purchase forms part of your transaction.
Automatically renewing subscriptions
If you purchase an automatically renewing subscription:
- payment will be charged through your app-store account;
- the subscription may renew automatically unless cancelled before the renewal deadline shown by the store;
- renewal charges will be based on the price and terms displayed by the store;
- you must manage or cancel the subscription through your device or app-store account; and
- uninstalling the app or deleting app data will not cancel the subscription.
Refunds
Refund requests are governed by the policies of the store that processed the purchase. Trigonom cannot directly issue a refund when the transaction is controlled by an app-store provider, unless otherwise required by law.
Restoring purchases
Where supported, previously purchased content may be restored using the same app-store account originally used for the transaction. Availability may depend on the platform, app version, and continued availability of the feature.
8. Advertising
Certain versions of our apps distributed through Google Play may display advertising provided by Google AdMob.
Where an app is directed to children, we configure advertising settings intended for child-directed or family use and follow the applicable platform requirements. Advertising availability may differ by app, version, country, or platform.
Third-party advertising providers may process limited technical information according to their own policies and applicable law. More information is available in our Privacy Policy.
The appearance of an advertisement does not mean that Trigonom endorses the advertised product or service.
9. School and Institutional Licensing
Standard consumer app purchases do not automatically authorize organization-wide, classroom-wide, or device-fleet deployment.
Preschools, kindergartens, schools, NGOs, libraries, educational organizations, and other institutions may request special licensing, volume pricing, or partnership arrangements at:
https://trigonom.al/licensing/
Submitting a licensing request does not itself create a license, partnership, discount, or contractual commitment.
Institutional use may require a separate written agreement or quotation from Trigonom. If a signed institutional agreement conflicts with these Terms, the signed institutional agreement will apply to the extent of that conflict.
10. Educational Purpose
Our apps are intended to support learning through educational activities, repetition, exploration, and play.
They are not a substitute for:
- professional teaching or individualized educational guidance;
- medical, psychological, developmental, or therapeutic advice;
- a formal assessment of a child’s learning ability or development; or
- appropriate supervision by a parent, guardian, or educator.
We do not guarantee a particular educational, developmental, academic, or behavioral outcome.
Parents and educators remain responsible for deciding whether an app is appropriate for a particular child, including the amount of screen time and level of supervision.
11. Acceptable Use
You agree not to use our apps or services:
- for unlawful, fraudulent, abusive, or harmful purposes;
- to attempt unauthorized access to our servers, databases, or systems;
- to introduce malware, malicious code, or harmful automated requests;
- to interfere with the availability or performance of our services;
- to collect information about other users without authorization;
- to impersonate another person or organization;
- to submit false or misleading support, licensing, or privacy requests; or
- in a way that infringes intellectual property, privacy, or other legal rights.
We may restrict or block access when reasonably necessary to protect children, users, Trigonom, or our technical infrastructure.
12. Intellectual Property
Trigonom and its licensors own all rights in the apps and their content, including:
- software and source code;
- app names and product presentation;
- characters, illustrations, icons, and graphics;
- animations, sounds, music, and voice recordings;
- educational activities and game designs;
- website content and layouts;
- logos, trademarks, and branding; and
- documentation and promotional materials.
“Trigonom” and associated names, logos, and visual marks are owned by Trigonom sh.p.k. or used with authorization.
You may not use our intellectual property for commercial, promotional, or misleading purposes without prior written permission.
13. Feedback and Communications
You may voluntarily provide feedback, suggestions, reviews, or ideas about our apps.
You retain ownership of your original feedback, but you grant Trigonom a worldwide, perpetual, non-exclusive, royalty-free right to use, reproduce, adapt, and incorporate that feedback for improving and promoting our products, without an obligation to compensate you.
This does not give Trigonom ownership of private support messages or personal information. Personal information submitted through support or contact forms will be handled according to our Privacy Policy.
14. Third-Party Platforms and Services
Our apps may depend on services operated by other companies, including app stores, hosting providers, advertising providers, operating-system providers, and device manufacturers.
Your use of those services may also be governed by their own terms and privacy policies.
Trigonom is not responsible for:
- the availability or performance of a third-party platform;
- changes made by an app store or operating-system provider;
- payment or account restrictions imposed by a store;
- third-party content, websites, or advertisements; or
- services outside Trigonom’s reasonable control.
Links to third-party websites are provided for convenience and do not constitute endorsement.
15. App-Store Terms
When you download an app from Apple, Google, Huawei, Amazon, or another authorized distributor, you must also comply with that provider’s applicable terms.
If these Terms conflict with mandatory app-store rules concerning distribution, purchases, refunds, subscriptions, or device use, the applicable app-store rules will control for that specific matter.
Apple App Store
For apps downloaded from Apple’s App Store:
- these Terms are between you and Trigonom, not Apple;
- Trigonom, not Apple, is responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- Trigonom is responsible for addressing claims relating to the app, subject to these Terms and applicable law;
- you must comply with applicable third-party terms when using the app; and
- Apple and its subsidiaries are third-party beneficiaries of the applicable app-license provisions and may enforce them against you.
Nothing in these Terms limits rights provided by Apple’s mandatory terms or applicable consumer law.
16. Updates, Compatibility, and Availability
We may release updates, corrections, improvements, or new versions of our apps. Some updates may be required for continued use, security, store compliance, or compatibility.
We do not guarantee that every app or feature will:
- operate on every device or operating-system version;
- remain available in every country or app store;
- remain compatible with older devices;
- operate without interruption or errors; or
- remain unchanged indefinitely.
We may modify, suspend, replace, or discontinue an app or feature. When reasonably possible, we will take account of active paid subscriptions and applicable legal obligations.
You are responsible for maintaining a compatible device, operating system, internet connection where required, and appropriate app-store access.
17. Support
We aim to provide reasonable support for our active apps and services.
Support availability, response times, supported languages, and the ability to resolve an issue may depend on the app, platform, device, and nature of the request.
Submit support requests at:
Our support service is not an emergency service.
18. Disclaimers
To the fullest extent permitted by applicable law, our apps and services are provided on an “as available” and “as is” basis.
We do not promise that:
- the apps will always be uninterrupted, error-free, or completely secure;
- every activity or feature will work on every device;
- defects will always be corrected immediately;
- the apps will produce a specific learning result; or
- third-party services will remain available.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Trigonom will not be liable for indirect, incidental, special, consequential, or punitive losses arising from the use of, or inability to use, our apps or services.
This may include loss of data, business opportunity, revenue, goodwill, or expected educational outcomes.
Where liability cannot be excluded, Trigonom’s total liability relating to a paid app or service will generally be limited to the amount you paid for that app or service during the twelve months before the event giving rise to the claim.
These limitations do not apply where liability cannot lawfully be limited, including liability for:
- fraud or fraudulent misrepresentation;
- intentional or willful misconduct;
- death or personal injury caused by negligence where such liability cannot be excluded; or
- violations of mandatory consumer or data-protection rights.
Your statutory rights remain unaffected.
20. Indemnification
To the extent permitted by law, you agree to reimburse Trigonom for reasonable losses, claims, or costs arising directly from:
- your intentional or unlawful misuse of our services;
- your infringement of another person’s intellectual property or legal rights;
- your unauthorized commercial distribution of our apps or content; or
- your material violation of these Terms.
This section does not apply to ordinary use by a child and does not limit rights or protections that cannot be waived under consumer law.
21. Suspension and Termination
You may stop using an app at any time. Subscription cancellation must be completed through the relevant app store.
We may suspend or terminate access where reasonably necessary because of:
- a serious or repeated violation of these Terms;
- fraudulent or unauthorized activity;
- attempts to compromise our systems;
- legal or app-store requirements; or
- discontinuation of an app or service.
Upon termination, your right to use the affected service ends. Provisions concerning intellectual property, liability, disputes, and other provisions intended to survive will remain effective.
22. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Albania, without regard to conflict-of-law rules.
Subject to mandatory consumer-protection rules, disputes that cannot be resolved informally will be submitted to the competent courts of Albania.
If you are a consumer living in another country, you may also benefit from mandatory rights and jurisdictional protections under the laws of your country of residence. Nothing in these Terms removes rights that applicable law does not allow you to waive.
Before beginning formal proceedings, you are encouraged to contact us through our support page so that we can attempt to resolve the matter.
23. Changes to These Terms
We may update these Terms when our apps, business practices, legal obligations, platform requirements, or services change.
The revised version will be published on this page with a new effective date. If a change materially affects your rights, we may provide additional notice where appropriate.
Continued use after the updated Terms become effective means that you accept the revised Terms, except where applicable law requires another form of consent.
24. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
A delay in enforcing a provision does not waive our right to enforce it later.
You may not transfer your rights under these Terms without our permission. We may transfer our rights and obligations as part of a reorganization, merger, acquisition, asset transfer, or similar business transaction, subject to applicable law.
These Terms, our Privacy Policy, applicable app-store terms, and any separate written institutional agreement constitute the relevant agreement governing your use of our services.
